Welcome to AgentSolar. By accessing or using our website, mobile application, and services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Services after any changes constitutes your acceptance of the new Terms.

2. Description of Services

AgentSolar provides AI-powered solar quote analysis, evaluation, and negotiation assistance services. Our Services include:

• AI-powered analysis and evaluation of solar installation quotes
• Price comparison and market insights
• Equipment and warranty assessments
• Installer research and company reviews
• Negotiation strategy recommendations
• Professional negotiation services (subject to separate agreement)
• Access to community quote data and insights

AgentSolar acts as an independent evaluation and coordination layer for the solar industry. We do not install solar systems, provide warranties, or offer financing.

3. User Accounts

To access certain features of our Services, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. Credits and Payments

Credit System

Our Services operate on a credit-based system. Credits are required for certain features, including quote analysis and advanced AI features. Credit pricing is displayed at the time of purchase.

Refund Policy

Credits are non-refundable except in the following circumstances:

• Technical Failures: If a technical error on our end prevents you from receiving the intended service, you may request a refund or credit restoration.
• Service Not Delivered: If you purchase credits but the intended service (e.g., quote analysis) fails to complete due to system issues, we will restore your credits or issue a refund.

Refund requests must be submitted within 30 days of the purchase date. To request a refund, please contact us at support@agentsolar.ai with your transaction details and a description of the issue.

Payment Processing

All payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service. We do not store your credit card information on our servers.

5. Negotiation Services

Professional negotiation services are subject to a separate Negotiation Agreement that must be signed before services begin.

If you choose to use our professional negotiation services, the following terms apply:

• A separate Negotiation Agreement will be provided and must be signed before we begin negotiating on your behalf
• Commission rates for negotiation services are specified in the Negotiation Agreement
• Commission rates may change from time to time at our discretion; any changes will be reflected in new agreements and will not affect existing signed agreements
• We act as your agent to negotiate better pricing with solar installers
• Success of negotiations is not guaranteed
• You retain full authority to accept or reject any offers obtained through our negotiation services

The specific terms, conditions, fee structures, and commission rates will be detailed in the separate Negotiation Agreement provided before services commence.

6. User Content and Data

When you upload quotes, documents, or other content to our Services ("User Content"), you:

• Retain ownership of your User Content
• Grant us a non-exclusive license to use, process, and analyze your User Content to provide our Services
• Represent that you have the right to share such content
• Acknowledge that we may use anonymized and aggregated data for analytics, market research, and service improvement

7. AI-Generated Content

Our Services utilize artificial intelligence to analyze quotes and provide recommendations. You acknowledge that:

• AI may make mistakes and results should be verified
• AI-generated analyses are for informational purposes only and do not constitute professional financial, legal, or engineering advice
• Final decisions regarding solar installations are your responsibility
• We do not guarantee the accuracy, completeness, or reliability of AI-generated content
• Market conditions and pricing can change, and our analyses are based on available data at the time of analysis

8. Prohibited Uses

You agree not to:

• Use the Services for any unlawful purpose
• Upload false, misleading, or fraudulent content
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Services
• Scrape, copy, or harvest data from our Services without permission
• Use automated tools or bots to access the Services
• Impersonate any person or entity
• Share your account credentials with others
• Use the Services to harm or defraud others

9. Intellectual Property

The Services, including all content, features, and functionality (including but not limited to text, graphics, logos, icons, images, audio, video, software, and their arrangement), are owned by AgentSolar and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from our Services without our prior written consent.

10. Third-Party Services

Our Services may integrate with or link to third-party services. We are not responsible for the content, policies, or practices of third-party services. Your use of third-party services is governed by their respective terms of service.

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any defects will be corrected. We do not guarantee any specific results from using our Services.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AGENTSOLAR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

Our total liability for any claims arising under these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless AgentSolar, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Services
• Your violation of these Terms
• Your violation of any rights of a third party
• Any content you submit or upload to the Services

14. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, with or without notice. Upon termination, your right to use the Services will immediately cease.

You may terminate your account at any time by contacting us. Upon termination, unused credits will not be refunded unless otherwise required by law.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Services shall be resolved through binding arbitration in Santa Clara County, California, in accordance with the rules of the American Arbitration Association.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and any separate agreements (such as the Negotiation Agreement), constitute the entire agreement between you and AgentSolar regarding the use of our Services.
